International Trade Commission (ITC) Proceedings

The International Trade Commission (ITC) is a government agency that investigates and tries patent, copyright, and trademark disputes involving imported goods. The ITC is, in effect, a specialized court with the power to stop importation, sale, and distribution of imports that infringe U.S. patents, trademarks, or copyrights. The ITC usually provides faster relief than the “normal” courts, partly because it has streamlined procedures and partly because it has the power to order U.S. Customs and Border Protection (CBP) to block importation of infringing goods. The ITC can also prohibit sale and distribution of imports already in the United States. It cannot award monetary damages—which are often much less important than speed when protecting your market from knock-offs.
